Welcome to Calmscrolling™, published by Parrhesiastes LLC, a Delaware limited liability company.

Calmscrolling™ is a calm-media service: gentle scenes, guided breathing and grounding exercises, and quiet music — the opposite of a doomscroll feed.

By accessing or using the Calmscrolling™ website, home-screen app, or related services (collectively, the "Service"), you agree to these Terms of Use (the "Terms"). If you do not agree, please do not use Calmscrolling™.

Who We Are

Calmscrolling™ is published by Parrhesiastes LLC dba Calmscrolling™ ("Calmscrolling™," "we," "our," or "us"). Our mission is to help people rest, breathe, and look at something gentle — without ads, feeds, counts, noise, or anything designed to hold your attention against your wishes.

What Calmscrolling™ Does (and Doesn't Do)

Calmscrolling™ provides calming images and video, guided exercises, and music for relaxation and everyday wellbeing. Calmscrolling™ content is provided for relaxation and general wellness purposes only — it is not medical, psychological, or other professional advice, and it is not a substitute for care from a qualified professional. If you are in crisis or experiencing a medical emergency, contact your local emergency services or a crisis line.

Calmscrolling™ operates independently of advertisers, political parties, and third-party commercial interests. We do not accept payment or influence from any person or organization in exchange for the content you see.

Creating and Using Your Account

To use Calmscrolling™, you'll need a Calmscrolling™ account. When you register, you agree to:

• provide accurate information and keep it updated;
• keep your login credentials secure; and
• use Calmscrolling™ only for lawful, personal purposes.

You must be at least 18 years old (or the age of digital consent in your jurisdiction, if higher) to use Calmscrolling™. By creating an account, you consent to receive essential service and account-related communications (you may opt out of non-essential messages at any time).

We reserve the right to suspend or close accounts that violate these Terms or misuse Calmscrolling™, as determined by us.

Passes, Pricing, and Payment

Calmscrolling™ is available through one-time passes — currently a 30-Day Pass and a 1-Year Pass — priced in your own currency where we support one, with all applicable sales tax or VAT included in the price shown. There are no subscriptions, no auto-renewals, and nothing to cancel. Pay one time and Calmscrolling™ is yours for your chosen membership pass period.

Each pass grants access to Calmscrolling™ for its stated duration from the moment it takes effect. If you buy another pass while a pass is still active, the new pass stacks: it extends your current access end date by its own duration, rather than starting a separate, overlapping period.

Gift passes. You may purchase a pass as a gift for someone else. A gift pass is redeemed by the recipient and then behaves like any other pass, including stacking with any pass the recipient already holds. An unredeemed gift pass can be refunded in full by the buyer within 14 days of purchase under our Refund Policy.

Payments are processed by Lemon Squeezy, which acts as the Merchant of Record and authorized reseller of Calmscrolling™ passes. Lemon Squeezy charges your payment method, calculates and remits applicable taxes, and issues your receipts. Lemon Squeezy's buyer terms also apply to your purchase.

Price changes. We may change the price or duration of passes offered going forward. A price change never affects a pass you have already purchased.

Refunds. You can get a full refund within 14 days of purchase if you haven't used your pass. If something on the site isn't working, tell us in writing at team@calmscrolling.com; if we don't fix it within 14 days, you can get a refund. Team Packs and gift passes follow the same terms. See our Refund Policy for details and how to ask.

Consumers in the EU, UK, and similar jurisdictions. You may also have a statutory right to withdraw from a purchase of digital content within 14 days. Nothing in these Terms limits mandatory consumer rights you hold under the law of your country of residence.

Card details. We never see or store your full card number. Payment details are collected and held by Lemon Squeezy and its payment providers.

Acceptable Use

You agree not to:

• copy, scrape, or republish Calmscrolling™ content or code;
• use Calmscrolling™ for commercial purposes without prior written permission;
• misrepresent Calmscrolling™ content as your own;
• interfere with Calmscrolling™'s operation or security;
• engage in behavior that could disrupt or degrade Calmscrolling™'s service, servers, or networks;
• upload malware or attempt to breach security controls; or
• use Calmscrolling™ content to train or improve AI models without our prior written consent.

Automated access that degrades performance or bypasses security controls is prohibited. We aim to keep Calmscrolling™ a calm, gentle space — please use it responsibly.

Intellectual Property

The Calmscrolling™ name, logo, trade dress, original scenes, original music, exercises, and other content we create are owned by Parrhesiastes LLC dba Calmscrolling™.

Some scenes and music in the Service are public-domain or openly licensed works by their respective creators; those works remain the property of their owners, and the original license governing each work applies to it. Credits shown alongside such content are part of the Service and should be kept intact.

You may view Calmscrolling™ content for personal, non-commercial use. Any reproduction, bulk download, republication, or use for AI training or dataset creation requires our prior written consent.

Content Ownership and Credits

Everything shown in the Service is either property of the Calmscrolling™ team, friends, or family, used here with permission, or a public-domain or openly licensed work created by others, included with the attribution shown alongside it and with what we in good faith understand to be the required permission.

If you believe you own rights in any content in the Service and would like it removed, send proof of ownership and your request to team@calmscrolling.com. We will promptly review every request and remove content while ownership is being verified.

Language and Translation Rights

Guided exercise audio is currently reserved for pass holders and available in English only at this time, except Box breathing, which is open to everyone. Audio in other languages is planned for the future. Silent exercises are available to all.

The Service may be made available in languages other than English. Any translations of Calmscrolling™ content — including scene titles, exercises, and other text — are provided by us, at our sole discretion, for your convenience and enjoyment.

All translation rights in Calmscrolling™ content are reserved by Parrhesiastes LLC dba Calmscrolling™. You may not translate, adapt, or create derivative translations of Calmscrolling™ content — by hand or with machine-translation tools — beyond viewing the translations we make available in the Service, and you may not publish, distribute, or otherwise use any such translation without our prior written consent.

All non-English content on Calmscrolling™ is machine-translated. We are working toward human translations of every language, but this may take time. Until then, a translation may be imperfect, awkward, or occasionally wrong.

In the event of any discrepancy or conflict between the English version and any translation — of these Terms, our Refund Policy, our Privacy Notice, or any other Calmscrolling™ content — the English version controls. Translations may be added, changed, or removed at any time.

Links to Other Sites

Where the Service includes links to third-party sites, they are for context and convenience only. A link does not mean that a source endorses Calmscrolling™ or that Calmscrolling™ endorses the source. We disclaim liability for reliance on third-party content.

Disclaimers

Calmscrolling™ is provided "as is" and "as available," without warranties of any kind, express or implied. We strive to keep the Service available and the content calming and accurate, but we cannot guarantee that the Service will be uninterrupted or error-free.

Guided exercises are gentle by design, but you know your body best — move at your own pace, and stop any exercise that doesn't feel right for you.

Limitation of Liability

To the fullest extent permitted by law, Calmscrolling™, Parrhesiastes LLC, and their affiliates (including officers, directors, employees, and agents) disclaim all indirect, incidental, special, consequential, exemplary, or punitive damages, and any loss of data, revenue, or goodwill arising from your use (or inability to use) Calmscrolling™.

If any liability is found in a final, non-appealable decision of a court or adjudicator of competent jurisdiction, our total liability for all damages relating to the product will not exceed the lesser of USD $39.99 or the amount you paid to Calmscrolling™ in the past 12 months.

Waiver of claims. To the fullest extent permitted by law, by using Calmscrolling™, you waive, release, and forever discharge Calmscrolling™ and Parrhesiastes LLC, together with their members, officers, directors, employees, and agents, from any and all claims, demands, causes of action, damages, losses, and liabilities of every kind — whether known or unknown, arising now or in the future — that relate to or arise out of your use of the Service, including your pass, the scenes, videos, exercises, and music, and anything you rely on them for. This waiver is a material condition of using Calmscrolling™; if you do not agree to it, please do not use the Service.

Termination & Indemnification

You may close your account at any time. We may suspend or terminate access if you violate these Terms, misuse Calmscrolling™, or if required by law.

The provisions on Intellectual Property, Acceptable Use, Disclaimers, Limitation of Liability, Indemnification, Governing Law & Dispute Resolution, and our Privacy Notice will survive and continue to apply after termination.

You agree to indemnify and hold harmless Parrhesiastes LLC, and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use or misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

Governing Law and Dispute Resolution

These Terms, and any dispute between you and Calmscrolling™, are governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-laws rules, together with applicable US federal law. No other law applies.

Most disputes between you and Calmscrolling™ can be resolved without resort to legal action. If you have any dispute with Calmscrolling™, you agree that before taking any formal legal action you will contact us at team@calmscrolling.com and provide a brief, written description of the dispute and your contact information. If you and Calmscrolling™ cannot come to a resolution within 60 days after informal dispute resolution is initiated, you agree that any disputes or claims between you and Calmscrolling™ shall be resolved by confidential, final, and binding arbitration, conducted at a location of our choosing within North America.

You further agree that Calmscrolling™ has the sole and exclusive right to choose the forum and venue for any dispute between you and us: any arbitration will take place at a location of our choosing within North America, and any court proceeding not subject to arbitration will be brought exclusively in the state or federal courts located in the State of Delaware, and you consent to their jurisdiction and venue. BY AGREEING TO ARBITRATION, YOU UNDERSTAND THAT YOU ARE WAIVING THE RIGHT TO SUE IN COURT OR HAVE A JURY TRIAL FOR ALL CLAIMS, EXCEPT AS LIMITED BY APPLICABLE LAW. To the maximum extent permitted by law, you waive any right to participate in class or collective actions against Calmscrolling™ or its affiliates.

California users retain any non-waivable rights under state law. Users accessing Calmscrolling™ from outside the USA agree that the exclusive venue for all disputes is the United States of America, chosen by us as set out above.

Consumers in the EU, EEA, UK, and Switzerland. Nothing in these Terms removes any right you have under the mandatory consumer-protection or data-protection laws of your country of residence, and nothing limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Where those laws give you the right to bring proceedings in your local courts or to rely on your local law, that right is preserved. Subject only to those non-waivable rights, Delaware law and the forum and venue chosen by us as set out above apply to the fullest extent permitted. If you are an EU consumer, the European Commission's Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr, although we ask you to contact us first so we can try to put things right.

Right of withdrawal (EU/UK). Where the law of your country gives you a 14-day right to withdraw from a distance contract for digital content or services, you may exercise it by emailing team@calmscrolling.com within 14 days of purchase. By starting to use the Service immediately, you ask us to begin supplying the digital content at once and acknowledge that, to the extent permitted by law, your right of withdrawal ends once supply has begun. Any refund we owe is issued through Lemon Squeezy, our merchant of record. This statutory right is separate from, and does not reduce, the refunds described in our Refund Policy.

Changes to These Terms

We may update these Terms from time to time. If changes are significant, we'll notify you in the app or by email. Continuing to use Calmscrolling™ after updates means you accept the revised Terms.

Service Availability and Modifications

We may modify, suspend, or discontinue any part of Calmscrolling™ at any time with or without notice. We are not liable for outages, network failures, or other events beyond our reasonable control.

Assignment, Waiver, Severability, and Entire Agreement

You may not assign these Terms without our consent; we may assign them at any time. Our failure to enforce any provision is not a waiver. If any provision is unforceable, the remaining terms remain in effect. These Terms, together with our Refund Policy and Privacy Notice, constitute the entire agreement between you and us regarding Calmscrolling™ and may not be changed except in writing signed or published by us.

For notices of alleged copyright infringement, please include your contact details, a description of the copyrighted work, the allegedly infringing material, and a statement made under penalty of perjury that you believe the use is unauthorized.

Unused passes: refunds within 14 days

You can get a full refund within 14 days of purchase if you haven't used your pass. A pass counts as used once any viewing has been recorded on it.

Many consumers in the EU, EEA, and UK also hold a 14-day right of withdrawal by law: where that right gives you more, we follow it.

If something on the site isn't working

If something on the site isn't working, tell us in writing at team@calmscrolling.com. If we don't fix it within 14 days of receiving your message, you can get a refund, whether or not you have used your pass.

Duplicate or unexpected charges

Duplicate or clearly erroneous charges will be refunded in full after Calmscrolling™ is made aware of them and confirms.

Gift passes

The person who bought a gift pass can get a full refund within 14 days of purchase if the gift hasn't been redeemed yet. Once redeemed, it follows this policy like any other pass, and the recipient's access ends if a refund is issued.

Team Packs

Team Packs follow the same refund terms. You can get a full refund within 14 days of purchase if none of the links have been redeemed. If some links have been redeemed, the unredeemed links can be refunded in proportion. Links covered by a refund are deactivated.

How to request a refund

Email us at team@calmscrolling.com with the email address you used at checkout. Payments and refunds are processed by our reseller and Merchant of Record, Lemon Squeezy.

When the money comes back

Once approved, the refund is returned to the original payment method. Banks usually show it within three to ten business days.

Your legal rights

Nothing here limits any mandatory refund or withdrawal right you hold under the consumer law of your country of residence, including the 14-day right of withdrawal available to many consumers in the EU, EEA, and UK.

This Privacy Notice applies to the Calmscrolling™ service, operated by Parrhesiastes LLC, a Delaware limited liability company, dba Calmscrolling™ ("Calmscrolling™," "we," "our," "us"), including the Calmscrolling™ website and home-screen app and any other product or service to which we apply this Privacy Notice (collectively, the "Service"), and describes how we collect, use, and disclose data, including personal data about you.

By creating an account on the Service or by using the Service, you are agreeing to be bound by this Privacy Notice.

Description of the Service

Calmscrolling™ exists to help you rest and breathe: calm scenes, guided exercises, and gentle, relaxing music — the opposite of a doomscroll feed. The Service has no third-party advertising or paid placements. We do not sell personal data, and we do not share it with advertising networks or data brokers.

Who Is Responsible for Your Data

Parrhesiastes LLC dba Calmscrolling™ is the data controller for personal data processed through the Service, contactable at team@calmscrolling.com. Lemon Squeezy acts as our merchant of record and as an independent controller of the payment and tax data it collects from you, under its own privacy notice.

Personal Data We Collect

We collect only the minimum amount of personal data necessary to provide the Service:

• Account information: your email address and password, used to sign you in and to run your account.
• Pass information: payment details are collected and processed by Lemon Squeezy, which acts as the Merchant of Record for your pass purchase. Lemon Squeezy handles your card details, billing address, and tax location; we never see or store your full card number. From Lemon Squeezy we receive only what we need to run your access: your pass type, purchase date, access end date, and the identifiers linking your account to your pass.
• Your preferences: choices like your track, saved scenes, and session settings are stored on your own device, in your browser's local storage — not on our servers.
• Service information: basic technical data (such as browser type, request logs, and a one-way hashed form of your IP address used only to meter the free-minutes trial) needed to operate, secure, and troubleshoot the Service.
• Usage counts: which pages, scenes and music are viewed and for how long, counted without cookies or browser storage and not linked to your account.
• Support messages: anything you send us by email, kept only as long as needed to help you.

Calmscrolling™ is not directed to individuals under 18 years of age, and we do not knowingly collect data from minors. If you believe a minor has registered for the Service, please contact us and we will promptly delete the account and related data.

How We Use Personal Data

We process personal data to:

• provide the Service to you, including your account and pass access;
• provide customer support and respond to your requests;
• maintain the security and reliability of the Service and prevent abuse; and
• meet legal, regulatory, tax, or audit obligations.

We do not use your data to build advertising profiles, and we do not send marketing messages designed to pull you back into the app.

Why We're Allowed to Process It

Where the laws of your country require us to name a legal basis, ours are: performing our contract with you (running your account, pass access, and billing), our legitimate interest in keeping the Service secure and working, compliance with legal obligations such as tax and accounting rules, and, where we ask for it, your consent, which you may withdraw at any time. We do not process personal data for advertising.

Who We Share Data With

We share personal data only with: our service providers (cloud hosting, storage, and email delivery) who process data on our instructions; Lemon Squeezy, as merchant of record, for sale of pass purchases, payments, tax compliance, and invoicing; professional advisers such as lawyers and accountants where needed; and public authorities where the law requires it. We do not embed advertising analytics, social-media pixels, or cross-site trackers.

The providers who process data on our behalf are:

• Lovable Cloud (hosting, database, authentication): United States / global — stores your account email, pass record, and service logs.
• Lemon Squeezy (merchant of record): United States / global — payment, billing, and tax data, under its own privacy notice.
• Email delivery provider: United States — sign-in links and essential account emails.

We have appropriate data-processing terms in place with each of these providers, and we review their practices periodically. We do not use advertising or analytics trackers such as Google Analytics or social-media pixels.

Cookies and Similar Technologies

We do not use cookies. We use your browser's own storage only to keep you signed in, remember your settings on this device, and keep track of the free preview minutes on this device. To learn which pages, scenes and music people use, we count visits on our own servers without cookies, without browser storage, and without any third-party analytics. These counts are not linked to your name, email or account. If your browser sends the Global Privacy Control signal, we count nothing from your visit. Our payment provider may set its own cookies on its checkout pages. We do not use advertising or tracking cookies.

Data Storage and Retention

We keep account data for as long as your pass access is active, and afterwards only as long as needed for legal, tax, or dispute-resolution purposes, then delete or anonymise it. Technical logs are kept for a short period for security and troubleshooting. Data may be stored and processed in countries other than your own.

Your Rights

Depending on where you live, you may have the right to access the personal data we hold about you, correct it, delete it, receive a portable copy, object to or restrict certain processing, and withdraw consent where we relied on it. California residents have the right to know, delete, and correct their personal information, and to be free from discrimination for exercising those rights. We do not sell or share personal information for cross-context behavioral advertising, and we never have.

Email team@calmscrolling.com to exercise any of these rights. We respond within the time required by applicable law, and we will not charge you or degrade your service for asking. If you are in the EU or UK, you may also complain to your local data protection authority.

Notice for the EU, EEA, UK, and Switzerland

Legal bases. We process your personal data to perform our contract with you (Article 6(1)(b) UK/EU GDPR), for our legitimate interests in keeping the Service secure, reliable, and free from abuse (Article 6(1)(f)), to comply with legal obligations such as tax and accounting rules (Article 6(1)(c)), and, where we ask for it, on the basis of your consent (Article 6(1)(a)), which you may withdraw at any time without affecting processing already carried out. We do not process special-category data, and we do not carry out profiling or automated decision-making that produces legal or similarly significant effects.

Your rights. You have the rights of access, rectification, erasure, restriction, portability, and objection. Email team@calmscrolling.com and we will respond within one month, as the law requires. You may also lodge a complaint with your local supervisory authority or, in the United Kingdom, with the Information Commissioner's Office.

International transfers. The Service is operated from the United States, and your personal data will be transferred to and processed in the United States and other countries whose data-protection laws may differ from your own. Where we transfer personal data out of the EEA, the UK, or Switzerland, we rely on appropriate safeguards, including the European Commission's Standard Contractual Clauses together with the UK International Data Transfer Addendum, and on adequacy decisions where they apply. A copy of the relevant safeguards is available on request.

Breach notification. If a personal data breach is likely to result in a risk to your rights and freedoms, we will notify the competent supervisory authority within 72 hours where required and inform affected members without undue delay.

Security

We are committed to keeping your data secure. To prevent unauthorized access, disclosure, or breach, we use suitable physical, electronic, and administrative safeguards, including encryption of data in transit and at rest and role-based access controls.

Change of Ownership or Business Transition

In the event of a change of ownership or control of Calmscrolling™ or a business transition such as the sale of some or all of its assets, we may disclose and/or transfer your personal data to third parties who will have the right to continue to use such data in the manner set forth in this Privacy Notice.

Updates

We may modify this Privacy Notice at any time and will make each update available on the Service. You are deemed to accept an update by continuing to use the Service. Unless we state otherwise, an update is effective 30 days after posting, except for immaterial corrections, which are effective immediately.
